We consider applicable legislation in force at the time of the dispute. This may include housing law, consumer protection legislation, tenancy deposit regulations, and any other relevant statutory provisions.

We take into account relevant codes of practice, professional standards, and guidance applicable to property professionals. This includes best practice expectations within the lettings, sales, and property management sectors.

3. Evidence provided by all parties

Our decisions are based on the documentary and factual evidence submitted by both parties. We assess the quality, relevance, and consistency of the evidence, including contracts, correspondence, inventories, reports, and supporting documentation.

4. Fairness and reasonableness

In addition to strict legal considerations, we apply principles of fairness and reasonableness. This ensures that outcomes reflect what is equitable in the specific circumstances of each case, particularly where legislation or contractual terms do not fully address the issue.

5. Contractual obligations

We consider the terms of any agreement between the parties(such as tenancy agreements or terms of business), assessing whether obligations have been met or breached.

Where financial awards are considered, we assess whether any loss has been directly caused by the actions or omissions of the property professional, and whether the loss is reasonable and evidenced.

7. Proportionality

Any remedy or award is proportionate to the circumstances of the case, reflecting the nature and impact of the issue identified.

8. Consistency of approach

We aim to ensure consistency in decision-making by applying established adjudication principles and learning from previous cases, while still considering the unique facts of each dispute.
